The Freedom of Information Act

The Freedom of Information (Scotland) Act 2002 (FOISA) provides you access to information held by any public authority. From 11th November 2019, FOISA has also applied to all Scottish Registered Social landlords.  In addition to the duties the Act places on organisations to respond to requests for information within set timescales, FOISA places a duty on RSLs to publish certain types of information and to adopt and maintain a publication scheme that has the approval of the Scottish Information Commissioner (SIC).   This must detail all of the key information that we publish and how you can access it.

Scottish Borders Housing Association (SBHA) has adopted the Scottish Information Commissioner’s (SIC) Model Publication Scheme (MPS).

The Information that we make available to you

Under the Model Publication Scheme, the information we provide must be listed under certain “classes” of information.   These are the categories of information that are detailed below. As FOI applies to other bodies and sectors across Scotland – such as Scottish Government and Councils for example –this means that not all of the categories in the MPS apply to housing associations/co-operatives.

You will need you to:

  • Give your name and address (e-mail or postal) so that we can reply.

You can add other contact information such as a telephone number.  It can help speed up the response if we can get in touch with you quickly to check a point.

  • Ask for the information you want.  Describe the information as clearly and as briefly as you can.

The clearer you can be on the information you you are requesting – if your request is too broad, it may be refused because of the cost of responding to it.

If you need the information in a particular format, tell us (for example, as a summary, or an audio version).  We will provide the information in the format you prefer as far as is reasonable. In deciding what is reasonable, we will not discriminate against you if you have a disability.

We will respond to your request within 20 working days.
